My local Ford Service Mgr agrees with the build date issue posted from mlh above. My Escape was built on Feb 11th, so I am good, and am pleased with its towability. The Texans info from above it hearsay and not quite correct.

My info came directly from the owner/GM of the Ford agency here and I see no reason for the owner to lie about it.
The Ford bulletin itself has been posted on the forum a dozen times and can be read by doing a little research. It was very specific about when.

Texan, it is important to provide factual info for any Escape owners, this is NOT a blanket "dont flat tow 4 down" Escapes communication for ALL Escapes, but a notification based on build date, which can only be verified by Ford owners on its owner website based on their VIN. The Ford bulletin you are referencing is a copy from an owner that meets the "don't tow flat 4 down" build date. This DOES NOT cover ALL Escapes. I can login to Ford with my VIN, and my on-line owners manual still gives to OK to flat tow and does not provide the addendum you reference. And, I do flat tow my Escape with NO ISSUES. Again, please dont provide skewed info to these Escape owners. Thanks.
Ford still is having problems with their transmissions. We have a 2011 Fusion and it has gone through 4 transmissions. Late last year after the 3rd transmission Ford agreed to put a Remco pump on our car at Ford's expense. Last week we took the car to Ford for basic service and asked that the transmission fluid be checked to be sure it was correct as we were planing a test trip of a few 100 miles to test everything before our 3 month summer trip. When I picked the car up the service adviser said that there was anew technical bulletin and the reprogrammed the transmission. On Monday night I decided to check the transmission level and it showed full,so I called the service department in the morning and was assured that that was the new level from Ford. WE left and 105 miles from home the transmission blew and also blew the Remco pump. I put a call into Ford this morning to let them know I will institute the Lemon Law to return this car.
