Depends on the CB-er... As a ham radio operator I often talk on the radio while driving, however I've learned to seperate those tasks. The thing is. Ham radio, if I have to pay attention to driving, I'm going to do so. Where as with cell phone if it's business I need to pay attention to the call.. Totally different mind set. It's the mind set that is most important. There are other factors as well but the telephone mindset is much more intense than the radio mindset.

I think they should ban listening to the radio, or CD player while driving also. I know it distracts some drivers who listen to the radio. You can tell they are distracted just by watching how they drive!!!

So lemme get this straight: I cannot listen to talk radio on headphonmes while driving. However, to talk on my cell phone, I MUST use headphones? Does anyone else think this is pretty weird?
I wonder if using the speakerphone setting on a cell would be legal? It would seem to be.

A cb does not have a set that you hold to your ear. You can listen without doing anything. Its usually not an invloved conversation that takes away your focus.
For many years cb's have been in use and rarely heard about talking on a cb causing an accident.
We believe that all states should have this law, and it should have been passed many years ago. Just think how many people who would still be alive today if that law would have been passed years ago. I don't know about the rest of you, but I stay well clear of anyone on a cell phone while driving. And since I live in Calif, I would be more than willing to stop, and make a call to the Highway Patrol, supply them with a picture, and lience plate number and a picture of the driver with their cell phone next to there ear. I hope Cell Phone Manufactors, will some day put something in cell phones, to make it so they can't even be used while your engine is running. All calls would be directed to their in box, but no ring present. I know most of you, probably have had at least one close call, do to a cell phone user while driving. It would be an easy fix, with todays technical knowledge. Personaly, I hope every cell phone user is caught and fined. Yes I have a cell phone, but I will not use it, or answer a call while driving. It can wait, until I am off the road, and stopped. I would also have my DW use the CB, and try and reach a Smokey, so that person can be stopped and fined also. I'm not a mean person at heart, but really tired of all the stunts that drivers pull using cell phones, and the lack of attention they have while using them. They all, are guilty of putting someone else's life constantely in danger. I hope the fine is huge, and really hurts the cell phone users. Happy Camping, Dan & Jill

Here in the province of Quebec they just enacted a ban on hand held cell phones and text messaging devices while behind the wheel. All cell phone calls have to be hands-free while driving.

I know talking on the phone can be a problem for some but I think this is an overreaction. What about talking to a passenger, singing to the radio, reading, putting on makeup, eating, looking at a map, changing the radio station, etc. All are distractions. And what about talking on a CB radio or 911 personnel talking on their radios while enroute to a call. See? It is all a distraction. Now, if a person was doing any of those and got into a crash, then yeah, write them a ticket for being careless.
