We're newly retired and can't sell our home, so we're going to rent and hit the road for a couple of years, then come back and figure out where we'll live. However, we really want to stay in California for the first two months of ownership for the grandkids. I thought I read CA laws that if you keep the RV out of state for 50% of 6 months, the you don't have to pay the sales tax? Does anyone know where I can look to figure this out, websites, phone #'s. I've been going in circles and don't feel comfortable believing the RV sales guys knowledge of the laws.

I believe the law states that you must keep the RV out of state for the first 60 days or you must then pay the state sales tax.

Here you go.. California RV SUT Tax from 2006 Haven't found anything newer yet. It does state 90 days from purchase that it has to remain out of the state. Not sure though about how registration affects that status. I would imagine that it would be considered as "brought in" if you registered it here. Therefore if you purchase you would have to purchase out of state and register it out of state. Being a resident of CA you have additional restrictions. Lots of details to read in the link.

I did that with mine. You can buy it locally, take DELIVERY of it out of state, (i.e. Nevada or Arizona). Do the paper work and drive it away. You are supposed to keep it out of state and have dated receipts to show that you were out the entire time. I used receipts from the post office, gas stations. Wal Mart etc. Be careful and double check your receipts when you turn them in. California is trying to tighten up this "loop hole".

Check with the State Board of Equalization, there have been several changes recently. At one point there was a 91 days out of the first 180 day rule that might have worked for you, days didn't have to be contigious if I remember right, not sure the exact specs. I'm not sure what all has changed, best to contact the state board and find out.

The law has changed a couple of times over the past few years but is now back to the requirement to keep the RV out of California for 91 days out of six months. It must be in use during that time, not just parked, and you have to keep records to prove that. We have done it and it works. It is a cheat. The program is officially sanctioned by the State.

The California Board of Equalization had a booklet called Publication 52 that explains the whole thing. You can download it from their web site. Check to be sure I have given you the right numbers concerning the months.

It is a general sales tax, not an RV tax.

Get the FRanchise Tax Board brochure on the subject and perhaps even contact an attorney that works in that field if you have any questions.

I used the law as it existed a few years ago, kept good records, spent 1/2 hour with one of their clerks at the local state office and saved $ 10,000 on use tax.
