We have a Ford F350 dually diesel pulling our 5th wheel
We were driving (without 5th wheel, on our way to work) down a main road in Ontario and were pulled over.

We got two tickets
one for not having a CVOR (commercial vehicle operator registration) one time (fine $250)
one for not having a PMCVI (periodic mandatory commercial vehicle inspection) yearly (fine $250)

We were told by the officer that we were 'lucky' he did not seize our truck and just gave us the two tickets.
We took our case to a place that fights tickets and he submitted a defense and asked for a court date.
An 'error' was made and while we were in Florida over the winter, the case went to court and we were convicted. When we returned we found my husband's license had been suspended for 'non payment' and his insurance cancelled because of the suspension!
We were then told this 'error' happens often in this particular area.
They arranged to have the case re-opened (Nov.\08) and helped us get insurance at 'double' our rate for 6 mths.
BTW my husband has never even had a parking ticket in 30+years of driving!
He got his license re-instated for a fee of $150 non refundable as well!

Following is why we were ticketed!

Re: CVOR
We got a ticket even though we are not commercial because the the truck was
considered commercial (on the ownership) because of its 'registered gross weight'
(weight of truck and the amount of load it can carry or pull) even though we were
not carrying or pulling at the time.

So...we reduced the 'registered gross weight' from 7000 to 4500 kg so that we no longer need
a CVOR. Because we reduced the 'registered gross weight rating' we are technically not able to
pull our rv of around 6000 kg.

However, the manufacturers 'gross vehicle weight rating' is attached to the vehicle with a plate on the
inside of the door. It will still have the larger number (which indicates it is still capable of pulling well over
6000 kg.)

So they let you change it but in effect it is not changed if you look at the door plate.
Catch 22!!

Re: PMCVI
We needed that because we were rated commercial. BUT we reduced it at the licensing office to non-commercial.
However, again that door plate rates us as commercial.
Again...Catch 22!!

Seems to that there might be a lot more to this story..... A very great many F350s on the road in Ontario. JMHO

Ouch!

I think we are going to see that here in the states, in the not to far distant future, with the states (claiming) being broke!

I insisted I was non commercial and she said it didn't matter what I was using the truck for, reg's state that vehicle rated over 4500Kgs. is AUTOMATICALLY subject to commercial regs. Argued at some length with her and she proceeded to get her BIG boook out and show me the reg. YOU should not have been charged as pick-ups are exempt with even a special notice sent out to all DMV's detailing how the new 450 & 550's are declared a special exemption as long as they remain equipped with the original pick-up box. Modify/remove that original box and the 450/550 reverts to COMMERCIAL status and a CVOR is required. That's what we get for attempting to tow our heavier trailers with a vehicle that is rated for the job. I guess these nitwits (MTO's & DMV's officers) prefer us towing them with 1/2 tons!

She even had the audacity to tell me that she would not have stopped me if I had been hooked to my RV. I said that made no sense to me because the truck did not change it's footprint by being hooked or unhooked. Altogether, a very unpleasant experience to note the commercial traffic on our highways is subject to being monitored for safety by these morons!

I would advise you and anyone to get a copy of "The Official Truck Handbook".
It is all there..as the saying goes...in black and white.

As I suggested to Heavyputer, check out the MTO handbook.

FYI We were stopped on Bayview Ave. just south of Hwy #7 in the middle of the
afternoon. It was a York Region officer. At the time, the York Region were on
a 'work to rule'. The officer who stopped us looked as if he should have retired
a few years previously. Must have been 'recalled'
We were both born and bred in this area as well.

Feel for you--it is so very frustrating and at the same time infuriating.
Did you challenge it in court or just pay the fine?
Does that exemption apply to F350's as well?
Do you know where I would get a copy of that exemption?

Can't help you with the yearly safety inspection sticker requirement. That's a given for duallies due to the GVWR, although many owners don't know it and most Cops let it slide unless your obviously commercial.
Annual truck and Trailer Inspection requirement

To show you how stupid the law is!! If you carry around a TC on your truck it's a motorhome and you don't have to have it inspected. As soon as you take the TC off it must be inspected yearly.

However with respect to the CVOR, here's a link to the personal use exemption for pickup trucks. Pay particular interest to the follow statement.

Pickups used for personal purposes only:
A pickup that is never used for business purposes and never tows a trailer that is used for business purposes is exempt from CVOR, daily inspections and hours-of-service rules. This applies regardless of the pickup's registered gross weight or any actual weights of the pickup and or trailer.

Ontario Min of Transport Personal Use exemption from CVOR

I'm sorry to say that you were done wrong by our all knowing government beaucrats.

I have written to two different Ministers of Transport in our fine province over the past 3 years and I have received the political bums rush every time regarding these and other issues pertaining to towing and licensing. The story is the same everytime. Were looking into it!!!!!
At this point the only reason to increase your registered weight on your truck license is a provincial cash grab.

MTO Truck driver handbook does talk about the CVOR as you inidcate but it does not go into enough detail to discuss exemptions (I have the handbook and have read it cover to cover) plus it is written for and directed at future OTR truck drivers onto which these regs would apply.

Again sorry to hear you got ripped off by the government.
