There is a biog on the net about similar ebay procedure with brand new luxury BMW that was listed below dealer's price. The winning bidder was persistent and got the car. Ebay has pretty strict policy on dealers ignoring the contract. Fact is that those guys are playing smarter with the toxin issue, but that shouldn't be too hard to clear?

Very definitely, make EBAY aware of the situation. They will not directly intervene, but will let the seller know that their auctions can have legal ramifications. Also, leave negative feedback and clearly describe your situation. It's the dealer's fault, as they could have specified an acceptable reserve price.

Without being specific, and speaking in roundabout terms, I have a long time friend that was in a similar situation with an EBAY auction. Needless to say, you do have a binding contract. One party in my friend's instance did pursue his "options," and was successful.

Ebay lawsuit down under

Here's a link for a similar case in Australia regarding a fighter jet listed on ebay. Seller got a side offer for nearly $100k more, but the courts made him sell it to the ebay bidder.

I had the same thing happen on a motorcycles Gl 1000 1975 for $2500 on a very low mileage once, ebay gives out ice in the winter on things like this.


2005 Chev 5.3 Supercharged 395HP 425 T hp. Two wheels on front, 2 on back. one seat, tint windows. front and rear bumpers, headlights, windows. Door on each side. Heater, floor mats, junk behind seats, some dirt. Pulls so hard.

They were Africanized Killer Bees no less. All in 110' Tucson in leaving the TT door open one day.

WOW. I didn't know you can make a good living out of ebay. I need to research this opportunity.
Widening the topic, I have my beef with ebay when they ignored me as a buyer, while they protected crooked sellers, but have to prize them for last changes. Now the seller can't leave retaliation feedback without going thru ebay procedure. What took them so long?
Hey! I am flying in 2 days to pick up "new" luxury car $10,000 below local dealers. Don't expect any surprises from ebay seller.

Why not send your buddy in Tuscon over to take a couple of pictures of the TT they 'don't even have any more'. If you do take legal action, it's one more mark against their credibility. If your friend should just not happen to mention that he is assisting you, and they think he's a buyer, he might even get to see about that horrid toxic smell in there. Or not. But it could save you a trip and help you win if you decide on legal action.
