Moving vehicle vs parked vehicle.

Glad you are "a hard core conservative thinking kind of guy who believes strongly in personal responsibility".

Did you give them your phone number and insurance company so they can get their vehicle repaired?

I had someone unhook his horse trailer in my driveway without permission. When I went around it on the right the righthand tire of my horse trailer went over a mound tipping a guard that protects the light switch up on the top of my trailer into the side of his trailer. His aluminum trailer was scraped down the side. I offered to split the cost of fixing his trailer - he was outraged and so I ended up having to cover the $2000 bill to fix his little scratch.

My understanding is it would be your fault completely. You were moving and they were parked. You're responsible for checking to make sure your path is clear before moving. It's the same as if you backed out of a parking spot with your truck and into a car stopped behind you.

Luckily, it was only a door and not the kid.

Lastly, regardless of what happened or who's fault, "Hispanic" is completely irrelevant to the entire story. It doesn't mater whether they were Hispanic, White, or from the planet Mars. What does that have to do with anything?

If the person is out of the vehicle it's your fault, no question about it. If the person thru open the door and you hit while they are still in the vehicle it's their fault. Doesn't matter where the parked vehicle is, lot, street, field etc. You hit a stationary object. Your fault. I do commend you for in your mind you thought it was their fault and you just said forget it. Prepare for good Karma.

A wreck at the dump with a poor family? What if you had hit some ambulance chasing lawyers properly parked vehicle? I'd keep an eye on those fenders.

If the other vehicle was sitting still and yours was moving I suspect you would have been adjusted to be at fault for the accident. Now if the damage occurred when they opened the door and it hit your truck, the decision would have gone the other way. I'm not a lawyer but I DID watch Peoples court
