So, why would you kill it anyway? Unless a direct threat, or in your yard - with kids - makes no sense.
Unless you threaten a rattler (or most any other wildlife) it will leave you along and go its own way. It's probably hunting rats, so unless you're a rat, you're in no danger.

When my youngest son was hiking with his scout troop at Philmont Scout Ranch in NM he walked right over the top of one.
They have to be provoked to strike, and most times won't strike until provoked excessively.
Around here killing them is illegal, (as in there is no season for them) unless you can show that you were in imminent danger from one.
I can tell you this, they are tasty. (that comes from eating one that was legally harvested)

Mohave rattlesnake (Arizona)

Both taken early in the morning while the snakes were still torpid.

I am not a snake person!! Don't like them, not even pictures of them. That said, we had a neighbor's 10 year old child bitten by copperhead last saturday. On a lawn that is well kept. Didn't step on the snake, just near it and it nailed her on the ankle. The EMS here life-flighted her to a children's hospital (Egelston) in Atlanta. Tremendous pain and swelling in the leg, and getting above the knee. The EMS folks told us they no longer use anti-venom. Apparently it has a detrimental effect on the body and is used "only as a last resort". I don't know what that means. This was a 30 + inch snake, which is LARGE for a copperhead in this area. It did not survive the post-bite encounter with the neighbor.
