I remember when this first happened- wondered what the outcome was!

The translation's a little rough, but it sounds like the natives might be allowed back sometime ...but what about the foreign folks that thought they "bought" land/lots???

Francesca: You are right about what you say. If you are withn 50 kms of the ocean and buy something, make sure you are prepared to lose it at some time in the future!! At this stage of my life, I am not going to buy anything Mexico or Canada . I can see that renting wherever I am gives me flexibility to move around with no committments until they roll me into the Care Home or put me in an Urn.

This is why I would never buy property in Mexico. The RV thing is perfect, when I can't do that, i will rent.

Lew, we feel the same about buying in the US or Mexico. The only time I would buy any land in Mexico is if I won the lottery, I would buy one of the places in the middle of the Flamingos Golf Course in Nuevo Vallarta.

This is an interesting subject for me- hope you don't mind if I ask some questions of you expert south-of-both-our-borders travelers:

Is it true that when you buy in Mexico,if you're a foreigner you don't get title to the land but only to the "improvements"? Or is that just a rumor?

There is no more risk in buying within the 50km zone as outside. Either can be risky if one gets "sloppy". Within that 50 km zone you do not get title to the property. A bank hold the title "in trust" Your trust is for the whole property: land and buildings. You have all the rights of an owner. Can be sold , willed, rented, etc. Mexico is unfortunately a land of scams. But many foreigners leave their brains at km21. They buy property with no titles. Do use a notary or good real estate agent. The notary is the most important part of the purchase. Find out if this land has been Ejido ( like a co-op) land. If so RUN AWAY quickly. There are hundreds of thousands of foreigners who own property both in and out of the 50 km zone with zero problems. There are many other issues with living in a home in Mexico which should be the subject of some other post.

On the topic of titled and untitled etc. We owned a house/land in Puerto Rico - part of the US but Spanish law still applies so it is basically the same system in Mexico - I said basically so not exact.

My Aunt owned a house in San Miguel de Allende and my sister also owned a house in SMA. Never a problem. But you need to know you have title - or as in the Mexico 50km bank trust that the bank has title.

Friends in PR bought untitled and many did just fine - did not want title because untitled pays no property tax. But some lost their property when a native born shows up and says that was my grandfather's land and he said it was mine and I have a letter from him saying so.

In PR the realtors do not do the transfer paperwork - it is all done by lawyers. In Mexico I would strongly suggest a good and highly recommended attorney for anyone thinking about buying property to make sure the sale is legal. You can own land but you have to be able to prove it.

The 50km rule says you must be native born to own land/property within 50km of the coast. We have friends who went to Hermosillo to have their baby so their daughter was born in Mexico and is a Mexican citizen as well as a US citizen. They legally bought land on the coast in their daughters name. Weird world we live in.

Google both bank trust and buying under a Corperation..

Very easy to find the Real info....

The notary is the most important part of the purchase, They will make sure the land is clear of all problems..

Some of the biggest frauds with real estate in the Mazatlan Area have been commited By a few Canadians in cahoots with some locals.. scaming there own.
