Deal with them entirely through an INSURANCE attorney. You are playing their game and they will string you along forever. Refuse to talk with them. Refer everything to your atty. They will get the message pretty fast.

Why should I be responsible to have the front section of my motor home pulled apart to look for the damage. The investigator took pictures of the tree that was hit and clearly said there was damage. BUT>>>>because he could not see where the smoke had come from he considered there to be no physical flame damage to the eye. So now I have to pull my motorhome apart, which is very scary to me, in order to prove where the smoke is coming from?????? IS that not what they are supossed to do? THERE WAS SMOKE< THERE IS DAMAGE< just can not see it until it is all pulled down, this included the front roof, passanger window has to come out as side panel is held down by window, etc.

All you've posted so far is "personal effects" clause, and clearly the only personal effects damaged is the TV, which they're going to pay for.

Do you have comprehensive coverage on the RV itself, and if so, are lightning strikes specifically mentioned as covered/not covered? Is there an "act of God" exclusion? That's where you should be looking- if all you have on the rig is liability and personal property, you're probably out of luck.

we have full coverage, comp and liability.

I have some familiarity with this stuff, so let's see if I can help...

This says they'll cover your damaged personal property; i.e. the TV. Personal property can be described as things you would take with you if you sold the MH.

Get a copy of your policy and get your agent to go over it with you. A separate section will talk about coverage of damage to the vehicle, and there will be a section on exclusions and "how we pay for a loss".

I'm concerned that somehow you don't have coverage on the vehicle - just on the contents of the vehicle. I say that because I've never seen a policy that doesn't cover damage due to lightning.

Before you contact an attorney you should talk to a Public Adjuster. They will aggressively handle the claim for you and they'll cost a lot less than an attorney. Probably do a better job, too, since that's their area of expertise.

to many variables in insurance policies and exclusions are everywhere in policies....i guess the bottom line is ask them exactly why they are denying the claim and go from there.

as for electronic devices there are always exclusions, usually you need to be specific on what is going to be covered.

MOST insurance companies pay what they owe. To do otherwise invites a charge of "unfair claims practices" which are illegal in every state. However, your adjuster is probably not allowed to pay for damage that he can't see, such as damages inside the wall. And, your policy undoubtedly requires you to prove the damage.

Take my advice and contact a public adjuster to review the claim. They get paid a percentage of the claim, so they run the cost up as high as they can get it. And they know how to work with the insurance company.

Have you tried calling the home office? If you've just talked to your adjuster you may have to take it a step further and talk it to the head of the company. Try the State Board of Insurance but don't count on them. We had a situation with house insurance and while they agreed that the insurance company was in the wrong they couldn't do a lot about it.

to OP--don't play around. this could drag on forever. they don't have to pay you anything 'no matter how much you talk' but once an 'attorney talks' it is a whole new ballgame.
