it surprises me that more states don't prohibit cell phone use while driving. when Washington did their thing, I bought a blue tooth thing to hang on my sun shade so I could use it.

I personally can't believe the number of people that drive while holding their phone up to their ear. They are usually too busy holding their phone to do things like signal lane changes........

I was behind a guy, in Chattanooga, who was driving awfully slow; holding up traffic, as he steered the car, dumping his cigarette ashes out the window and holding the phone to his ear, totally involved in his conversation.

I'd RATHER they concentrate on the driving BEHAVIOR than the perceived CAUSE of the behavior. Some people seem to drive just fine while talking on the phone and lots of others can't maintain their own driving lane even when NOT on the phone. If the driving is erratic get em off of the road rather than a specific ban on cell phones when the driving behavior may not be suffering at all. I'm amazed at the number of times I follow someone driving right down the middle of two traffic lanes and when I finally pass them find no reason for it at all except they can't drive.

In California, starting July 1 2008, "Hand held" cell phone use will be banned, but a "Hands Free" cell phone can stilll be used if you are over 18 yrs of age.
Quote from DMV Vehicle code:
23123. (a) A person shall not drive a motor vehicle while using a wireless telephone unless that telephone is specifically designed and configured to allow hands-free listening and talking, and is used in that manner while driving.

23124. (a) This section applies to a person under the age of 18 years.

(b) Notwithstanding Section 23123, a person described in subdivision (a) shall not drive a motor vehicle while using a wireless telephone, even if equipped with a hands-free device, or while using a mobile service device.

So if you are under 18, NO CELL, Over 18, Hands free like a blue tooth ear piece.

Commercial Truck drivers can use a "Push to talk" phone. And there are a few others mentioned like tow truck drivers.
Good Law in my opinion.

You can still use a CB radio.

Of the few states that have the law, I'm amazed at the almost total lack of enforcement.
I've seen people with a cell phone up to thier ear,at a stop light, right next to a cop.Why bother with a law, if you're not going to enforce it.

An even BETTER question might be "Why pass a law that is impossible to enforce" like limiting use to those over 18 years of age? That would be an enforcement nightmare and would ONLY serve as an additional charge to throw at someone you just wanted to punish. The reason for lack of enforcement MAY be that it is listed as a "secondary offense" meaning that they can only enforce it if you pull them over for some OTHER reason first. Could ALSO be the reason for passing a law that cannot be enforced any other way.

What gets me is the restriction to "hands-free" sets only. Every credible study has shown it's NOT the holding of the cell phone that is the distraction, it is the conversation. Yet there go our politicians, passing yet another series of unenforceable laws based solely upon emotion, lobbyists and junk science.

skipnchar, I agree with both of your posts. I'm a big fan of personal responsibility. There are some folks that just shouldn't be driving...PERIOD. Cellphone, tune the radio, light a cigarette, etc...there are some folks that can barely do any of the above while chewing gum, let alone drive an automobile.

Using the cell phone while driving is just the tip of the iceburg! As a professional driver I have seen many things people do while driving, such as knitting...giving self a hair trim...playing guitar...shaving...using laptop...and many acts I won't describe since this is a family forum! As long as this continues, people will die. Very sad.
