Get a lawyer. I fooled around for 2 years trying to get something similar straightened out myself. Every time I thought it was all taken care it would show up again in 2 or 3 months. I had to pay the lawyer. But he did get everything corrected in about a month. That was 10 years ago.

I think I would get a lawyer. All of this should be handled by the lender who botched this up, not by you. A lawyer should be able to file suit to have the problem resolved AND cover his costs on your behalf. It's your good name and credit that was damaged by them, so they have the responsibility of repairing it at their expense.

Sounds like a justified lawsuit to me.

Under the law, you are entitled to 1 free credit report every year from each of the three credit reporting agencies. To get that report, go to www.annualcreditreport.com. From there, after you obtain your free reports AND PRINT THEM, you can dispute them. The web site will provide detailed information on how to do this. Any information that isn't accurate has to be removed.
The site will direct you to the individual sites for the 3 agencies, and you will need to provide your report numbers. You are also able to provide a "statement" that will be included with your report in the future, that others viewing your report can see.
Note, that if you use a different web site, like freecreditreport.com, (the TV commercial) you will automtically be enrolled in a "not free" credit monitoring service.
EVERYONE can and should check their credit report every year.

One of my loans got screwed up back when I got married (years ago) and they had it under both my maiden name as well as my married name (with two separate account numbers). In addition to a personal visit to the loaning bank, I sent 'written letters' indicating the problem, and did receive a response, I photocopied both my letter and the banks response and sent copies to the 3 credit bureaus.....who did actually clean up my credit report! In speaking with one of the credit bureaus, they said 'the key is to send something in writing'.

I was told by the original lender my credit was straightened out that's why I applied. My credit union said to give them until the end of the month to have it removed. They said they would check it for me. If it's not removed they said I should file a fraud report with the credit agencies and with the attorney generals office. If the attorney generals offices finds cause for a law suite they will act on it at no charge to me. This sounds like good advice. As soon as my credit is returned to what it should be I'm going to refinance the loan through the credit union. I as the dealer to finance it through them in the first place since this is someone they use for financing but when I went to pick up the TT they said they already had everything setup through this lender by mistake. The rate was the same so I figured they were getting some type of spiff from this lender and it wouldn't change anything for me.

I get annoyed when dealers do this - in reality there was no mistake. They made additional money off of your financing with their lender, don't let them try to tell you otherwise.

Actually, it's much easier than this. Contact the 3 repositories and they will give you all the information you need in order to dispute the incorrect reports. The consumer protection laws in this area are very clear, no need to spend even $1 on an attorney.
Also, if you have been turned down for credit, each of the repositories are required to provide you a free copy of your credit report so you may dispute any incorrect information. The lender who declined your request is required to send you notification and will provide contact information for the repositories.
I don't know what's your experience, but I've been trying to correct my wife listed under my SS for years. I posted a comment calling credit reporting agency "idiots" and they keep on printing the report with my comments unchanged for years.

I wonder if it would be of any help, since the dealer was the agent for the bank, to advise the dealer you will be including them in the lawsuit for financial damages. Just a thought.

Vanman,
Unfortunately, problems like yours happen very frequently these days.
Years ago, it used to be very difficult for people to have their credit report corrected, as individuals didn't have access to their credit report. Recent legislation changed all that.
Why involve all these different people when you have the power to fix this yourself? Involving the Bank, Dealership, Credit Union, lawyers, State's Attorney's office just complicates the matter and in the long run, will take more of your time and aggravation, and probably will delay getting your report fixed.
If your ultimate goal is to get your credit report corrected, refer to my last post. It is really quite simple. Our family has found the need to do this twice within the past two years.
If you are imagining this as your big opportunity to gain a large windfall of damage money for yourself through a lawsuit, forget about it. It is a correctable mistake. It happens all the time. Get it corrected and move on with your life.
