I'm now in DuQuoin, IL at the Newmar Rally. My neighbor was approached by a revenue agent yesterday. The agent was inquiring about the Montana tags on his DSDP. He also has Montana tags on his car. The agent is checking every coach at the rally for irregularities. I am guessing it is a Illinois agent and only interested in folks evading Illinois taxes.

Looks like the various states are getting active in looking for tax evasion. If you're legal, no problem, doing it illegally could cost you bigtime!

it has nothing to do w/the plates on your wheels, it's the address that is on your id that counts. and i'm still not sure it could be enforced then, ea. state is set up different on how you can claim for plate status. some that i have delt w/is where is it setting on a certain date others has been where do you use it the most. as long as the plates are legal in that state for that item there's not a lot that they can do, except harass and rage, time to let this issue die.....

A little story. I live on the MA/NH border. NH is sales tax free and many MA residents naturally shop in NH. Years ago the MA Dept. of Revenue sent agents up to NH to take down all the MA license plates at the NH State Liquor stores to see who was evading/avoiding the liquor tax that the Commonwealth of MA felt was due them. The govenor, I believe it was Thompson told the MA Dept of Revenue that if it continued he would have them arrested. That ended that. My kind of guy. If someone from MT was asking questions in the state of IL, I'd tell them to get lost.

It wouldn't be someone from Montana, they are happy to get the business. When Coors beer wasn't available in North Dakota, it seemed to be the beer everyone wanted. Whenever someone would go to a state where it was available, they would bring back several cases. If you got caught you were fined and the beer confiscated. Now that it is available it isn't very popular.

The earlier guess was that the agent was from Illinois. I would have the following questions RE: the incident.

1) Was the rally held on private property? If so, why was the agent allowed to be there doing "inspections" and questioning participants? And I would inform the property owner and Newmar that the allowed violation of their customers' privacy is not appreciated.

2) Did the agent have search warrants to do his "research" or probable cause of some kind of crime (which I think still would require a search warrant)? Without a warrant, I don't think anyone is obligated to answer his questions, no matter where their coaches/toads are registered.

I don't mean to seem like a "guilty party" but I do think such an agent doing this type of "inspection" (interrogation) could be a violation of folks' civil rights (5th Amendment??).

By the way, our MH and cars are registered in our state of residence, not Montana.

Do you really think taxing authorities need warrants to do audits or come to your premiss?

Send them away if you want, if you do their work is considered final unless you prove it wrong and the burden of proof is on you. They are not going to bother with you unless you have some form of attachment to the state they work in. If you do and they catch you its going to be a long uphill battle.


One thing in this world for sure you don't screw with is taxing authority. So go ahead and piss them off they have more power than any cop or federal agent because they can literally put you through tons of hoops and if you don't jump the burden of proof falls to you.

Fair? No. But if it wasn't like that they'd never collect a dime in taxes.

Living on the NYS / Pa border, we saw the same thing. NYS Tax Agents going down to Erie, Pa mall parking lots to look for NYS license plates on the customers cars. Also get it just outside the indian reservations when people get stopped with to many cartons of cigarettes. Two cartons is the limit. They get hauled off the jail and their vehicles are impounded. Happens all the time here. Usually people from NYC or Michigan.

Actually it's going to get HOTTER as more states catch on and strengthen their laws and prosecuting the violators. Tax evasion is illegal, tax avoidance is not and a lot of what people are doing is evasion and carries penalties.
