I'm aware of what DMV is saying as well as CHP, but if you read the text of the law it is really not all that clear. So I go back to what I already said, it's a poorly written law. It should have specified what they wanted more clearly.
Well apparently the powers that be ie DMV and CHP have interpreted it as above. The beat cop or traffic cop should not be taking it on himself to interpret it the way HE decides the law reads.
I mean the DMV and CHP I am sure, have consulted state attorneys and determined this is the official interpretation of the law, who is the traffic cop to override them.
As I said some of these traffic cops are going to be wasting taxpayers dollars because they think they know better

What would you like me to tell you? All I can say is a DMV interpretation and a CHP interpretation hold no weight of law. If Los Angeles has somehow interpreted the law differently then it's up to the courts to decide. In my reading of the law I tend to think DMV and CHP are wrong in their interpretation. But then again I go back to what I've said twice now, it's a poorly written law. Maybe you should send your complaints to the legislature who wrote it.

If you never had a family member or friend that was killed or hurt badly by someone running a red light while talking on their cell phone, or driving into their lane, then I can see why you said this. I have a close friend that was hurt very badly by a woman running a red light while talking on a cell phone. Put my friend into the hospital. Hit so bad that their heart was bruised! That lady that caused the accident, only got charged for running the red light.
I wish they would pass a nation wide law against cell phone usage while driving or text messaging or anything related to cell phones. Also other activities done while driving. Some people just can't do two things at same time.

Nice place. In some areas. Of course, a "living wage" in most areas there is rich folks income here, and I wouldn't live anyplace which has BOTH an income tax and a sales tax. That, in and of itself, could cause "distracted driving"!
Hey, don't forget Minnesota. We have both an income tax and a 6.5% sales tax. Plus the "big" cities have their own "piggyback" sales tax additions. We'd be living in the Flathead Valley right now, but the wife doesn't like the mountains surrounding her.

As most every state has a inattentive driving and / or negligent driving statute it seems these new laws are just "do gooder" type things that do little more than adding more weight and wasted space to the lawbooks. Why not just enforce the current laws already on the books?
Yeah, I know....them legislative numskulls have to look like they are actually accomplishing something.
