I just bought a trailer from a dealer in michigan and also traded my old trailer in to him. But he says I can not have my new trailer until he recieves the title back from the bank of my old trailer which he is paying off.He said it could take a month at the most in the mean time I don't have a trailer to go camping with .HELP

Get your old trailer back to go camping until the title from your old trailer is received by the RV dealership. Why should they hold your old trailer ransom while you sit at home unable to use either trailer. It's just not right.


I want to leave this earth quietly in my sleep like my grandfather and not like the hysterical, screaming passengers riding in granddad's RV just before the big crash.

Then I would just keep my old trailer. Sure would not give hime my old trailer while he keeps the new trailer and you now have money or payments invested in new trailer yu can't have. Something smells like rotten fish here. RUN AWAY!

A quick call to whomever registers and licenses vehicles in your state should make the procedure very clear. If you have completed the transaction there is no logical reason for him to retain physical possession of your property. Once you are clear about the law in your state, tell him you will be picking up your new trailer and will be calling the state police and attorney general's office if you have any problem taking possession of your property. Something sounds suspicious here. By his logic, it would be virtually impossible to operate a car dealership in your state. The next issue will be if it sits there for a month and gets damaged, magically it will then be YOUR property, that you needed to insure, and he can't be held responsible.

But remember he cannot sell your old trailer until he has that title so he is protecting himself from being stuck with a unsellable trade in. Perhaps you need to contact the bank holding the title to the old trailer and see if you can speed up the process.

Did you lose the title for the old trailer and the dealer has to apply for a lost title? Have you already signed the paperwork for the new trailer?

I would think that if you signed for the new trailer that it is yours, not his anymore.

If the title does not come through, then it is a civil matter, and if you can not work it out between the two of you, then you go to court. Until the title comes through, it is the dealer's problem, not yours.

If the trailer is yours, take possession of it. If they will not let you take possession, go to the Police Station or Sherriff's office. Tell them your story, show them the documents, and see what they have to say about it.

I think they will also agree that the trailer has been paid for by you and it yours. They should help you take possession of the trailer that you have already paid for.

I would contact the bank myself and ask if there has been a payoff on your loan. Explain that if they have the payoff or when they get the payoff, could they expedite sending the title back to the dealer. If they have not made the payoff yet, contact the dealer and ask just when he intends to make the payoff. You have completed your part of the deal and he needs to complete his payoff as soon as posible to keep his part of the deal. I suspect that you signed a contract that included your buying price and the payoff price so he already has paper to get the money from his finance company to make the payoff. Good Luck

In our state, the dealer verifies ownership, payoff amount, and has the customer sign a release of interest. Done deal the same day.

Dealer can immediately put the trade-in up for sale, as he has 45 days to furnish the title after he sells the rig.

Sounds fishy to me too.

I would at the very least get my old trailer back and use it until this is sorted out. Why should you not be able to use your old trailer?
