Be careful what you wish for...

I had a 4 year fight with my idiotic HOA over a basketball goal post back in 1992. I won the court fight AND the appeal. Unfortunately, we do not have loser pays in Texas, yet. I Thank God that we were able to find a pro bono attorney that could not believe the HOA sued me over something so trivial.

The upside is the HOA does not mess with me any more, and I am a part of Texas's case law.

I can well understand why some people would choose not to live in an HOA neighborhood. There is a certain freedom to having full control of the property one owns. On the other hand, why do people knowingly purchase property in an area with a HOA and then refuse to go by the rules that were available to them at the time of purchase?

I own homes in two different HOA's and don't agree with certain restrictions in each of them. I also know that if I can get enough people to agree with me, the rules can be changed. Otherwise, I follow the rules.

Dee this is one of the things we ran into when inquiring about HOA on a couple of the subdivisions we were looking in over there. The realtor told us about such things being known to happen. No thanks! The road dues in some of those places were bad enough, but understood why they were needed.
The road maintenance fees only cost us $60.00 a year....SMALL amount considering they clear our roads of snow (last year they came every 3 days for over 3 months) and they gravel and clear the roads. Believe me, it's SUCH a small amount.....I don't complain!

Because the rules can change or can be "reinterpreted" by a bunch of power hungry people (I wanted to use another term for "people", but this is a family forum). My parents had a deck on the back of their house that was identical to the decks on many other houses. It was there when they moved in. They got a notice saying they would have to remove the deck. When my parents pointed out it was identical to the other "approved" decks, the response was that it was built by an unapproved company. As it turns out, the only "approved" company is owned by the president of the HOA. So to keep their deck, they had to have it "modified" by the approved company.

My parents have moved out of that HOA and made sure their next house was not in a HOA.

Thank god we do not have to deal with such rules, I believe that every other house on the block has at least one pickup, not to mention those rather loud Harleys that the biker types fire up and let idle for 10 min while they let them warm up prior to their weekly road trips, certainly my neigbour Tim would be quite upset if he had to reconstruct his garage to be able to hold his F350 HD addition pickup to fit into his garage with his $100,000 chopper! Myself I would have to rebuild my garage and add on another 10 ft all the way around to allow me to park my 3500 Dodge into the garage, along with my beloved DW's Mazda.....

I paid a good portion for my house and I would hate for some snotty type to bang on my door and telll me to park my truck in what they try to pass off as a garage, I also paid a good price for that Dodge, and oh yeah the 5er wasn't cheap also........it is parked in the backyard year round and can be seen by everybody that travels that #2 highway between Edmonton and Calgary.

I don't know, but that truck just looks like it would attrack the wrong class of people. Wish I had one in my driveway. Like your truck.

You know, I think in some parts of the country it is considered weird not to own a pickup of any kind. They would hate our house, two dodges and on ford, none of them all that new.

Hi all,

I can understand that there are those on this blog that don't understand why anyone would impower a home owner association to restrict their rights. I currently live in the country, but use to live in a very tight urban community where everyone lived in town homes. Believe me, we needed a HOA there to restrict the rights of the meat heads that though that if they didn't want to mow their lawns, or paint their houses (every) or build a deck right up against your fence so they could look right through your windows, or keep you're idiot neighboors from inviting their friends to part in your assigned parking space.

When you live in very close proximity to one another, you need to start defining all sorts of rules. And yes, their stupid behavior if unchecked by a HOA can effect you're property values.

Now, that being said, yes, HOA's can go overboard.
